| Guarantee of quality
We guarantee that our customers will be satisfied with the class of their choice. If a student sends us a written notice of dissatisfaction with a class within two weeks of the last day of class, the student will have the option of retaking the class at no charge, applying prepaid tuition fees against another class enrollment, or receiving a full refund of any tuition paid for that class. Students will be required to return all materials provided as part of the class, including class certificates.
Class tuition & early enrollment
The class tuition fee will be invoiced upon enrollment. If you are paying by credit card payment can be made when you enroll. If you are paying by other means, such as a company purchase order, terms of payment are "net 30." The class tuition fee includes instruction; class materials; the use of software, computers and other technical hardware as appropriate to the class; and eligibility for System Technology Institute Certification Examinations when appropriate. System Technology Institute also provides light refreshments during morning and afternoon breaks. The class tuition fee does not include sleeping rooms, meals, travel or any other expenses that may be incurred by our students.
Substitutions
If you cannot attend your class you are welcome to send someone in your place, provided you notify us in writing before the first day of the class. 100% of any prepaid class tuition fees will be credited against the class tuition fee of the substitute. However, the substitute may not take advantage of any discount program for which he or she is not otherwise qualified.
Flexible transfer & cancellation policy
Transfer
Our flexible transfer policy lets our students enroll early with confidence. We do not impose any penalty for transfers to another class as long as we are notified in writing or by phone before the start of the class. If a student transfers to another class before the start of class in which originally enrolled, 100% of tuition fees will be applied toward the tuition fees for the subsequent class.
Cancellations
Our cancellation policy allows our students to cancel enrollment before the end of the early enrollment period without any penalty. For any cancellation made before early enrollment ends we will void any outstanding invoice or, if payment has already been made, we will issue a credit or refund of all tuition fees for the cancelled enrollment, at your option.
Cancellations made after early enrollment ends will be subject to a 25% cancellation fee; the balance will be refunded. Alternatively, the full amount of tuition can be credited toward a future enrollment as a "transfer."
Enrollment cannot be cancelled less than two (2) weeks before the first day of class. If you wish to change your enrollment within two weeks of the beginning of class you can still "transfer" to another class, but a refund for the cost of enrollment is no longer available.
Any unused credit expires 12 months after their date of issuance.
No shows
"No shows" are responsible for their full cost of tuition. Failure to notify us of a cancellation or transfer in writing or by phone before the start of the class constitutes a "no show" and will result in forfeiture of the full tuition.
Postponements
At times we must change a class location, date, or postpone a class. In such situations we will give our students as much advance notice as possible of any such change. If you are unable to attend because of the revised location or date, we will credit 100% of any prepaid class tuition fees paid against a future class or, if requested, refund those fees. However, we will not be liable for any other costs incurred including, for example, travel charges or any consequential damages even if we were advised of them.
On-site terms
Notice of cancellation must be provided no less than thirty (30) days prior to the first day of class. A cancellation fee of up to 25% of the class fee may apply if notice is provided less than thirty (30) days before the first day of class. On-site classes are not eligible for a full refund under our Guarantee of Quality policy. We do not impose a fee if an on-site class needs to be rescheduled provided that we are given at least fifteen (15) days prior notice of the need to reschedule. Notice of rescheduling of the class must be provided in writing. Notice of rescheduling must be provided no less than fifteen (15) days prior to the first day of class. A rescheduling fee of up to 25% of the class fee may apply if notice is provided less than fifteen (15) days before the first day of class.
Payment terms
When you register as a student at System Technology Institute, you agree to pay all charges on your account when due. You also acknowledge that failure to make the required payment by the stated deadline will result in late payment and service charges, inability to enroll in future classes and withholding of a certification or transcripts. If you do not receive a bill, you are still responsible for payment by the due date. Late payment fees are assessed at 3% (three percent) per month service charge on the unpaid balance.
Ownership and copyright
Unless otherwise noted, all course materials, including, but not limited to all text, editorial content, images, graphics, logos, illustrations, photographs, video, audio, and other materials, as well as the designs, icons, layout, "look and feel," and all other graphical elements of the course materials, our web site and all copyrights, trademarks, service marks, tradenames, patents and other intellectual property rights in any of the foregoing (collectively, the “Materials”) are the sole and exclusive property of System Technology Institute (or its subsidiaries, affiliates, or designees) or its third-party licensors, and are protected by U.S. laws and international treaties. By enrolling in any course or workshop you do not become the owner of the Materials, but are entitled to use them as specifically permitted under these terms and subject to all additional intellectual property notices, information or restrictions provided in the Materials.
STI exclusively owns all worldwide copyright, title and interest in and to all of the Materials (including without limitation all related Intellectual Property Rights), from the time that it is created, authored, invented, discovered or first reduced to practice, and neither you nor any of your personnel nor any students shall retain any right, title or interest therein or thereto.
Restrictions on use of materials
Except as permitted under the “Permitted Uses and Prohibitions” Section, below, no Materials may be copied, reproduced, sold, rented, modified, republished, uploaded, downloaded, posted, transmitted, displayed, distributed, or otherwise used in any way; provided however, that where specifically permitted, subject to the provisions of any applicable Legal Notice (described below), each enrolled student may use a single copy of the Materials for his or her own personal, non-commercial use only, provided all copyright and other proprietary notices contained in the original Material are kept intact at all times.
Permitted uses and prohibitions
STI grants to each enrolled student, subject to these terms and conditions, a non-exclusive, non-transferable license and right to use the Materials and view video components (if any) or web site content (if any) and listen to audio components (if any) in connection with the course(s) or workshop(s) he or she enrolls in, for his or her own personal, non-commercial use only.
Neither you nor any enrolled students are permitted to copy, reproduce, modify, republish, upload, download, post, sell, lease, license, rent, transfer or in any manner distribute or otherwise use or permit others to use any Materials or any copies thereof. You must not reverse engineer, decompile or disassemble any Materials.
This license to use the Materials will also automatically terminate if you fail to comply with any these Terms and Conditions. In the event this license is terminated, you must immediately destroy any of the Materials in your possession or to which you have access.
No warranty
NEITHER WE NOR ANY THIRD PARTY WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, PROMOTION OR MARKETING OF THE MATERIALS MAKES ANY WARRANTY OR REPRESENTATION, EXPRESSED OR IMPLIED, WITH RESPECT TO THE MATERIALS, WHICH ARE LICENSED "AS IS". ALL WARRANTIES ARE EXPRESSLY EXCLUDED AND DISCLAIMED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USE OF TRADE. ANY STATEMENTS OR REPRESENTATIONS MADE BY ANY OTHER PERSON OR ENTITY ARE VOID. YOU ASSUME ALL RISK AS TO THE QUALITY, FUNCTION, PERFORMANCE, AND ACCURACY OF THE MATERIALS.
Limitation of liability
IN NO EVENT WILL WE OR ANY THIRD PARTY WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, PROMOTION OR MARKETING OF THE MATERIALS BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, RELIANCE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, OR FOR INABILITY TO USE THE LICENSED MATERIALS, EVEN IF WE, OR SUCH OTHER THIRD PARTY, HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR, OR SUCH OTHER THIRD PARTY'S, LIABILITY FOR ANY DAMAGES OR LOSS TO YOU OR ANY OTHER PARTY EXCEED THE COURSE MATERIALS FEE YOU OR YOUR INSTITUTION PAID FOR THE MATERIALS.
General terms
These terms and conditions set out above represent a complete statement of the agreement between the parties and supersede all prior discussions, correspondence and representations. Our brochures and advertisements are for information purposes only and are not intended to form any agreement between System Technology Institute and the recipient. We reserve the right to vary the content of any course, modify its syllabus or otherwise make alterations to the format and content of any course at any time. These terms and conditions are subject to change without notice, and changes will apply to any enrollment/class order received after the date of the change. These terms and conditions may not be varied except in a written agreement signed by an officer of System Technology Institute or its parent company, Boss Logic, Inc. System Technology Institute's acceptance of a purchase order containing different terms and conditions does not modify or supersede these terms and conditions. This agreement will be governed by California law, without regard to any conflicts of law.
